Contesting a guardianship of a child

Definition

Legal issues related to objecting to, challenging, or seeking to stop a guardianship over a child that someone else is asking a court to establish or has already established. This includes contesting a proposed or existing guardianship on the grounds that the parent is fit, the guardianship is unnecessary, proper procedures were not followed, or the arrangement is not in the child’s best interests. It may involve court hearings, evidence about parental fitness, termination or modification of guardianship, and emergency or temporary orders.
